REWARD PROGRAM TERMS AND CONDITIONS (MATCHPOINTS™)
PROGRAM DESCRIPTION The Game.Set.Match MATCHPOINTS Program (the “MatchPoints™ Program”) is a loyalty program designed to encourage your participation in all the events, leagues, programs and activities offered on the Game.Set.Match platform through which you can earn points (“MatchPoints™”) whenever you participate and later redeem them for offers, services, events, and much more. Membership in the MATCHPOINTS Program is free of charge and is available to anyone who opens a user account with Game.Set.Match.
Membership in the MATCHPOINTS Program is open to (i) residents of the United States and Puerto Rico (together “United States”) who are 13 years of age or older and (ii) have a valid email account. Employees and contractors of Game.Set.Match and its subsidiaries cannot participate using employee discounts.
You are automatically enrolled in the MatchPoints Program when you open an account with Game.Set.Match’s website or Apps. Please note that, while several fields of information are optional (including your physical address etc.), we might require your additional when redeeming your MatchPoints™ for products or services that require a physical address to ship your items to.
You can use your Account to track your participation in the MATCHPOINTS Program and redeem your MatchPoints™ for rewards. You are responsible for maintaining the security of your Account, and you are responsible for all activities that occur under your Account. If you believe your Account has been compromised at any time, you are responsible for contacting us immediately by contacting Customer Service at 1-904-476-4283, or firstname.lastname@example.org.
If we need to communicate with you about the MATCHPOINTS Program, we’ll send a message to the email address associated with your Game.Set.Match account. If your email address changes after you register, you are responsible for promptly updating your Account.
We may also send you promotional emails related to the MATCHPOINTS Program. You may optout of promotional emails by following the instructions in the emails. However, please note that you will still continue to receive emails related to your leagues, tournaments, event subscriptions and purchases.
Members can accumulate and redeem loyalty rewards MatchPoints™ on an individual basis and solely for their own Account. Membership is personal to you, non-transferable, and subject to these Terms and Conditions as well as any other rules, regulations, policies, and procedures disclosed by Game.Set.Match. There is a limit of one membership per person.
Companies, groups, association, or others making commercial or bulk purchases are not eligible for membership. The MATCHPOINTS Program may not be used for reselling or for profit of any kind without written permission by GSM.
You can earn MatchPoints™ in the MATCHPOINTS Program in the United States (i) by signing up and participating with any of the available leagues, tournaments, events offered by organizers on our Game.Set.Match platform (See Rules for details on MatchPoints™ earned when participating with these different events), or (ii) by performing other activities (online and offline), as communicated from time to time by the MATCHPOINTS Program.
Your MATCHPOINTS Program statement, where you will see a detailed account of all your MatchPoints™ earned and redemption history, is available online by going to the Reward section of the website and App.
THE MatchPoints™ YOU EARN ARE PROMOTIONAL ONLY, HAVE NO CASH VALUE, AND DO NOT CONSTITUTE ANY PROPERTY OF ANY KIND. YOU CANNOT SELL OR TRANSFER YOUR MatchPoints™ OR COMBINE THEM WITH ANOTHER MEMBER’S MatchPoints™.
When you redeem your reward MatchPoints™ for tickets to an event or tennis clinic directly from a Rewards vendor partner (“Experience”), it is important to note that your journey to, attendance at, and journey from the Experience will be governed by the terms and conditions of our vendor partner issuing the ticket for the Experience. For this reason, we ask that you ensure you have read and agree with the terms and conditions of any such tickets.
Product or prizes earned from MatchPoints™ cannot be shipped to military addresses or outside the United State of America.
CHANGES, TERMINATION, OR REMOVAL FROM PROGRAM
You may deactivate your Account at any time with Game.Set.Match by following the menu item under your Settings. If you cancel your Account, or if it is terminated for any reason, any MatchPoints™ which remain in such Account will be forfeited.
Game.Set.Match may, at its sole discretion, terminate, alter, limit, suspend, or modify the MATCHPOINTS Program, and/or these Terms and Conditions, rules, regulations, or benefit at any time, without notice or cause, even though such modifcations may affect the ability to earn or redeem MatchPoints™. It is your responsibility to check or review these Terms and Conditions from time to time to keep informed of any changes. However, Game.Set.Match may, at its discretion, notify members of any material change at least thirty (30) days in advance of the effective date of any change.
Change notices may be communicated by postings in the MATCHPOINTS Program, by emails to members, or by any channel deemed appropriate by the program at the time of communication.
Interpretation of these Terms and Conditions shall be at Game.Set.Match’s sole discretion. Game.Set.Match’s failure to exercise or enforce any right or provision of these rules shall not constitute a waiver of such right or provision.
In case of suspected fraud, misrepresentation, abuse, or violation of these Terms and Conditions, Game.Set.Match reserves the right to take appropriate administrative and/or legal action, including the termination of your MATCHPOINTS Program membership.
LIMITATION OF LIABILITY
Game.Set.Match will not be liable for any system failure or malfunction of the MATCHPOINTS Program or any consequences thereof. Game.Set.Match accepts no liability for any loss or damages arising from suspension, variation, termination, or in any other way relating to the MATCHPOINTS Program, except for any liability which cannot be excluded by law.
These Program Terms & Conditions shall be governed by the laws of the state of Florida in the United States. Any dispute, claim, or controversy arising or relating to these Program Terms and Conditions and the MATCHPOINTS Program shall be resolved by the courts in the State of Florida.
